This Privacy Policy ("Privacy Policy") applies to your use of our website https://www.kplor.com/ ("Platform") and product offered through the Platform (hereinafter collectively referred to as "Offerings") which are owned, controlled and operated by Mindshift Labs Private Limited ("Company" or "Kplor"), a company incorporated under the laws of India, having its principal place of business at #413, 14th C Cross, Pai Layout, Bengaluru - 560016, operating under the brand name Kplor.

For the purposes of these Terms of Use, “we”, “our” and “us” shall mean the Company and “you” and “your”, shall mean a user of the Offerings, whether registered or not (“User”).

This Privacy Policy sets out what data we collect and how and why we use it, when you access the Offerings. You are advised to read the Privacy Policy carefully before accessing any Offerings. To access any Offerings, you are required to accept the terms of this Privacy Policy. By accepting this Privacy Policy, you signify that you have read, understood and agree to be bound by the same. Kplor is committed to protect Users' privacy and appropriately and responsibly use collected data. By way of this Privacy Policy, we aim to provide you a summary of our privacy practices regarding personal data that we collect and process of/about the User through various sources. The primary focus of this Privacy Policy is on the personal data collected and processed. Depending on the purposes of processing and your relationship with us as a data subject, we may provide additional customized privacy policies.

“Personal Information” shall mean the information which identifies a User i.e., first and last name, identification number, email address, age, gender, location, photograph and/or phone number provided at the time of registration or any time thereafter on the Platform.

We request you to not provide Kplor with any Personal Information unless specifically requested by us. In the event you share with Kplor any Personal Information without us having specifically requested for the same, then we bear no liability in respect of such Personal Information provided by you.

We only collect information about you if we have a reason to do so — for example, to provide our Services on the Platform, to communicate with you, or to make our Services better.

Information We Collect From You:

Basic account information: In order to access certain features of the Platform, you will need to create an account and register with us. We ask for basic information which may include your name, an email address, your university/college name, and password, along with a username and phone/mobile number.

We may also automatically receive, collect, store and process certain anonymous data sourced by your usage of the Offerings, such as standard usage logs, through the web server, cookies, standard web log data, traffic to and from our Offerings, tracking within the same, and any other available data from:

an IP address, assigned to the Device (as defined below) used by the User;
type of browser used by the User;
the domain server through which the User accesses the Offerings and the functions and features therein;
queries, comments, or feedback as submitted by the User, including any correspondence you have made with us; and
the type/model/make of device used by the User (“Device”).

In order to enhance our ability to provide a valuable experience to the Users while accessing/using the Offerings, we may seek and receive one time or continuous access to:

Camera access to scan and analyze facial expressions
Microphone access to interact with the user

It is further clarified that we do not sell your data to any third party under any circumstance as the purpose of collecting data under this Privacy Policy is to deliver/enhance a quality User experience or improve our Offerings in a manner we deem fit and necessary.

Your Rights

This Privacy Policy is governed by your rights as per applicable law within the territory from where you access our Offerings.

Right to Confirmation and Access: You have the right to get confirmation and access to your Personal Information that is with us along with other supporting information.
Right to Correction: You have the right to ask us to rectify your Personal Information that is with us that you think is inaccurate. You also have the right to ask us to update your Personal Information that you think is incomplete or out-of-date.

We take reasonable steps to ensure that User data is available only for so long as is necessary for the purpose for which it is processed, or longer, if required under any applicable law, subject to appropriate safeguards. Please note that we ensure that all data collected and stored is de-identified. Furthermore, you explicitly consent and agree that we will be entitled to use such de-identified data or data freely, without any restrictions other than those set out under applicable law.

We shall use generally accepted industry standards to protect the User data submitted to us, both during transmission and upon receipt. However, please be advised that, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, even though we strive to use commercially acceptable means to protect User data, we cannot guarantee its absolute security and your use of our Offerings is at your sole risk and discretion. We also cannot warrant that such User data may not be misused in the event our safeguards and protocols are breached maliciously. Further, we are not liable to, nor can we fully control the actions of other users with whom you may choose to share your data.

If any security breach comes to our knowledge, then we may take all steps required to protect misuse of such data and may attempt to notify you electronically so that you can take the appropriate steps.
